What gull is it?

When I first saw this go out in the field. I thought it was a Herring gull, however looking at the picture tonight, I am not sure. This gull has a dark orbital ring rather than a orange-yellow orbital ring, gray legs, and the gape at the mouth is dark, not yellow.

Could you say when and where Myer. The legs in the image look gray but that could be because they are in shadow. If they were pinkish then this looks like a Herring Gull.
