I'm not so sure that I would rotate this image, the beach was naturally sloped, and I think the upper bird would end up in a totally unnatural position, like he was falling backward. Cropping off the bottom solves this problem for me. I love the light and the effect that you were able to achieve as a result, and the action is killer. The entire lower bird looks soft, again, I like the effect...adds to the beaten down feeling. Can you tell that I love this image??
I love this image and the light is fabulous. The pose and sharpness of the upper bird are great. If you select the head of the lower bird with a QM try a contrast mask, Unsharp Mask: 15/65/0 or thereabouts. It can often save the day in situations like this. As running the contrast mask sometimes darkens the selection a bit you may need to lighten it with a Curves ADJ on the layer: Control M and pull up the curve.
Forgot to mention that the processing is spot on on this one. You might consider cleaning up the few black thingies along the surf line, especially the stuff behind the lower bird.
